Girl caused bus tormentor to stab himself, court told

GUELPH, Ont. - A 15-year-old girl who took matters into her own hands when a classmate behind her refused to stop pressing on the back of her school bus seat has pleaded guilty to a weapons charge.

As the bus rumbled through Fergus, Ont., last September, the girl put an end to the harassment.

She took out a knife and put it against the seat causing her tormentor to stab himself in the palm.

In a Guelph court on Friday, the girl responded with a squeaky "guilty" when asked how she pleaded to a charge of possession of a dangerous weapon.

A second charge of assault with a weapon was withdrawn after assistant Crown attorney Murray DeVos conceded the girl had not actually applied force to another person and therefore could not be convicted of assault.

The girl was riding a school bus home about 4:15 p.m. last Sept. 27 when the 16-year-old boy behind her repeatedly pushed on the back of her seat, even after she asked him to stop, Justice Michael Epstein heard.

Finally the girl took out a folding knife, opened it and held it so the blade was pointing toward the back of her seat.

The next time the boy pushed the seat, he got the tip of the blade in his palm.

The boy sustained a small cut on his hand and needed minor medical treatment.

Police tracked the girl down at her home near Elora, Ont., later that evening and she admitted what she had done.

Defence counsel David Doney said his client was expelled for the balance of the school year.

"I understand how frustrating (the boy's) conduct was ... but the use of a knife in the circumstances was dangerous," Epstein said.

The teen was given a conditional discharge and placed on probation for six months.
